Four Rulings Given by Justices on Tuesday 

On Tuesday the Supreme Court issued their opinions on the cases of McKinney v. Arizona, Rodriguez v. Federal Deposit Insurance Corp., Hernandez v. Mesa, and Monasky v. Taglieri.

McKinney v. Arizona saw the court split in a 5-to-4 vote upholding the death sentence of James McKinney, stating that he did not have a right to be resentenced by a jury following his first death sentence being thrown out. 

The court ruled unanimously in the case of Rodriguez v. Federal Deposit Insurance Corp. that the federal common law doctrine known as the Bob Richards rule does not apply in cases and will no longer be used in court. The rule assumed entities responsible for losses get the resulting tax refund unless there was an argument otherwise. 

Hernandez v. Mesa again saw the court split 5-to-4 stating that people in Mexico whose family members were killed by American border agents shooting across the U.S.-Mexico border could not bring a lawsuit against the agents.

Lastly, Monasky v. Taglieri had the Court vote unanimously interpreting the Hague Convention’s definition of a child’s “habitual residence” in cases of child abduction, and that all the details of the case must be considered before making a judgment on if the child should be returned to another country.
